Overview


  • In-House Experience: Firasat's in-house experience includes patent prosecution, licensing, portfolio management, and client counseling on various intellectual property matters. 


  • Law Firm Experience: Firasat's law firm experience includes patent and general civil litigation, patent prosecution, licensing, monetization of patents, IP due diligence for mergers & acquisitions and strategic investments, IP asset assessment and valuation, and taxation of IP.  He has also acted as primary counsel for companies and helped them with day-to-day corporate and IP issues.


  • ITC Experience: Firasat's ITC experience primarily consists of patent and trademark litigation.

Sample Cases


  • Lockheed Martin Corp., Lockheed Martin Corp. v. Boeing Co.  (U.S. District Court for the District of Delaware):  Successfully opposed motion to dismiss and summary judgment in a monopolization case involving U.S. Air Force's Evolved Expendable Launch Vehicle (EELV). 
  • Amgen, Inc., Amgen Inc. v. F.      Hoffmann-La Roche LTD et al. (U.S. District Court for the District of      Massachusetts):  Represented Amgen, Inc. in a patent infringement    lawsuit against Roche involving multiple patents relating to   biopharmaceuticals and obtained a successful jury verdict. The jury  returned a verdict of infringement of each of the patents-in-suit and held that the patents were valid. 
  • Geomas   Limited, Geomas (International)    Limited, et al. v. Idearc Media Services-West (U.S. District Court for   the Eastern District of Texas): Represented Geomas in a matter relating to   search engines and databases for conducting geographical and topical    searches.  The case settled favorably for Geomas. 
  • AU Optronics, Plasma  Physics Corp. et al. v. AU Optronics Corporation (U.S. District Court      for the Eastern District of New York): Represented AUO in multi-defendant   action involving plasma-enhanced chemical vapor deposition technology for semiconductor fabrication. 
  • Extreme  Networks, Inc., Extreme Networks, Inc. v.   Enterasys Networks, Inc. (U.S. District Court for the Western District  of Wisconsin):  Represented Extreme Networks in a three patent      infringement lawsuit relating to managing communications data and quality   of service in computer networks.  The jury returned a verdict in   favor of Extreme Networks and found that Enterasys infringed each of the  patents-in-suit.  The case resulted in a permanent injunction against      Enterasys and an order to destroy defendantâ's infringing product     inventory. 
  • Extreme  Networks, Inc., Enterasys Networks,     Inc.  v. Extreme Networks, Inc. (U.S. District Court for the  District of Massachusetts):  Represented Extreme Networks in a six patent  infringement lawsuit for managing communications data.  The case has  been stayed pending reexamination. 
  • Tercica,  Inc., Genentech, Inc. & Tercica,   Inc. v. Insmed Incorporated et al.      (U.S. District Court for the Northern District of California): Represented    Tercica, Inc. as trial counsel in a victorious jury trial relating to   patent infringement claims in a biotechnology case involving recombitantly  produced hormones that enable children of short stature to grow.  The  jury found infringement on all-awards suit and willful infringement of one      of the patents-in-suit resulting in a significant upfront payment and royalties  that were awarded to Tercica and Genentech. 
  • Extreme  Networks, Inc., Lucent Technologies v.      Extreme Networks, Inc. (U.S. District Court for the District of   Delaware): Represented Extreme Networks as trial counsel in a victorious Delaware   jury trial relating to patent infringement claims for managing  communications data.  The jury returned a verdict in favor of Extreme      Networks. 
  • Coapt Systems, Inc., Z. Paul Lorenc, M.D. v.   Coapt Systems, Inc. (U.S. District Court for the Southern District of      New York):  Represented Coapt Systems, Inc. in a patent infringement    lawsuit relating to a resorbable surgical implant for use in supporting   soft tissue in a superior position in the body.  The case settled  favorably for Coapt Systems. 

International Trade Commission (ITC) Cases

  • Spansion LLC and Spansion Inc., In the Matter of Certain Semiconductor Chips with Minimized Chip Package Size and Products Containing Same.  (U.S. International Trade Commission):  Represented Spansion LLC and Spansion Inc. in an ITC  action involving semiconductor packaging technology.  In a rare and historic decision, the Administrative Law Judge (ALJ) stayed the case,      based on parallel reexamination proceedings.  Subsequently, the ALJ  returned a verdict of non-infringement on all the patents in favor of Spansion / Respondents.      
  • Trend Micro Incorporated, Certain Systems for Detecting and Removing Viruses or Worms.  (U.S. International Trade Commission): Represented complainant Trend Micro Incorporated as counsel in a victorious ITC trial relating to patent infringement case for anti-virus technology.  The commission returned a verdict in  favor of complainant, Trend Micro Incorporated. 
  • In the Matter of Certain Agricultural Tractors Under 50 Power Take-off  Horsepower. (U.S. International Trade Commission): Represented the International Trade Commission as a member of its Office of Unfair Import Investigation in a Trademark infringement action brought by Kubota Tractor Corporation et al. (Complainant) against Eisho World, Ltd. et al.  (Respondent). 
  • In the Matter of Certain CD-ROM Controllers and Products Containing Same  II. (U.S. International Trade Commission): Represented the International Trade Commission as a  member of its Office of Unfair Import Investigation in a Patent infringement action brought by Oak Technologies (Complainant) against  United Microelectronics (Respondent). 
  • In  the Matter of Certain Mechanical Lumbar Supports and Products Containing  Same. (U.S. International  Trade Commission): Represented the International Trade Commission as a member of its Office of Unfair Import Investigation in a Patent infringement action brought by McCord Winn Textron, Inc. (Complainant)  against SchUkra Manufacturing Inc. (Respondent). 
  • In the Matter of Certain Lens-Fitted Film Packages. (U.S. International Trade Commission): Represented the International Trade Commission as a member of its Office of Unfair Import Investigation in a patent infringement action brought by Fuji Photo Film Co., Ltd. (Complainant) against Achiever Industries, Ltd. et al. (Respondent).    

IP Due Diligence / Mergers & Acquisitions

  • Firasat worked on, led, and, and managed several IP due diligence projects, where he advised clients on potential IP issues. These projects include due diligence for mergers & acquisitions, strategic investments, and IP taxation.  For example, Firasat provided advice for Internal Revenue Service (IRS) Investigations and controversies concerning transfer of intellectual property assets in a merger/acquisition setting.  His work involved assessing the value and tracking the movement of intellectual property assets from the date of merger/acquisition through to its current migrated state into various products at the company.  Firasat's work resulted in a successful outcome for the client in defending intellectual property valuation controversies with the IRS.  Representative corporations involved in such mergers/acquisitions activities include the following:
